How can you ask your fiancé (e) to travel to the United States to get married and formalize your marriage?
If you are a US citizen, you can apply for a K-1 Visa Fiancée, which we will discuss in the following two steps:
First step
- (1) that you met in person within the past two years prior to your request (there are some limited exceptions to this requirement);
- (2) that they will be legally married within the first ninety (90) days after their fiancée enters the United States; and
- (3) that you are fit to marry and that there is no legal impediment to legally marrying.
Second step
Once your Petition for Fiancée I-129F is approved, your fiancée must begin the process of applying for a K-1 Visa by filling out form DS-160 and scheduling an interview with the American consulate in your home country. The K-1 Visa is treated like an immigrant visa for all relevant purposes because the ultimate intention of your fiancée is to immigrate to the United States. This means that the interview with the consulate will be rigorous to confirm that there is a serious dating relationship and that all the requirements discussed are met.
What are the basic documents that I will have to file with my K-1 Visa?
You must include a letter from both parties describing your intention to marry and that they meet the above requirements. In addition, they must also include evidence of their courtship such as travel, correspondence, letters, photos, etc.
